TalentPredix Limited (‘TalentPredix’) is committed to respecting and protecting your privacy and personal information. 

This policy explains when and why we collect personal information about you, how we use it, the conditions under which we may disclose it to others, how we keep it safe and secure and your rights and choices in relation to your information.

Personal data we collect

The personal information we collect, store, and use might include:

  • your name and contact details (including postal/delivery addresses, email address, and telephone number),
  • information about your activities on our website and about the device used to access it, for instance, your IP address and geographical location,
  • demographic data we collect from you and your clients or respondents for research purposes
  • assessment data we collect from you and your clients/respondents,
  • billing and credit card details. If you make an online purchase, your card information is not held by us. It is collected by our third-party payment processors who specialize in the secure online capture and processing of credit/debit card transactions, and
  • any other personal information shared with us.

Data protection laws recognise certain categories of personal information as sensitive and therefore requiring greater protection, for example, information about your health, ethnicity and religion.

We do not usually collect sensitive data about you unless there is a clear and valid reason for doing so and data protection laws allow us to. 

Where appropriate, we will make it clear why we are collecting this type of information and what it will be used for.

How we use personal data

We may use your information for a variety of different purposes, which may include:

  • providing you with the services, products or information you requested, 
  • processing orders that you have submitted,
  • carrying out our obligations under any contracts entered into between you and us,
  • keeping a record of your relationship with us,
  • conducting analysis and market research to better understand how we can improve our services, products or information,
  • checking for updated contact details against thirdparty sources so we can stay in touch if you move (see the section on ‘Keeping your information up to date’ below),
  • seeking your feedback or comments on the services we provide,
  • notifying you of changes to our services,
  • using Google Analytics, LinkedIn InsightTag and Facebook pixel, for the exclusive reason of, tracking website and marketing performance. Tracking information will be used by them if you consent to the use of analytics cookies (more on cookies below).
  • sending you communications which you have requested and that may be of interest to you. These may include information about campaigns, new products and activities and promotions of solutions and services, and
  • processing job applications.

Storage of personal data

We keep your information for no longer than is necessary for the purposes it was collected for. The length of time we retain your personal information for is determined by operational and legal considerations. For example, we are legally required to hold some types of information to fulfil our statutory and regulatory obligations (e.g. health/safety and tax/accounting purposes).

We review our retention periods on a regular basis.

Sharing personal data

We will not sell or rent your information to third parties.

We do not share your information with third parties for marketing purposes.

However, we may disclose your information to third parties in order to achieve the other purposes set out in this policy. These third parties may include:

Approved third parties working on our behalf

We may pass your information to third-party service providers, suppliers, agents, subcontractors and other associated organisations for the purposes of completing tasks and delivering services to you on our behalf (for example to ensure we can effectively deliver a workshop or coaching session). However, when we use these third parties, we disclose only the personal information that is necessary to deliver the services and we have a contract in place that requires them to keep your information secure and prevents them from using it for their own direct marketing purposes. Please be reassured that we will not release your information to third parties for them to use for their own direct marketing purposes, unless you have requested us to do so, or we are required to do so by law, for example, by a court order or for the purposes of prevention of fraud or other crime.

Third party solution and product providers we work with

Our trusted and carefully selected third-party solution providers offer a range of quality and reliable products and services designed to meet the leadership and coaching needs of clients. Only when you directly enquire about or purchase one or more of these products or solutions, will our approved third-party partners use your details to provide you with information and carry out their obligations arising from any agreements you have entered into with them. They will be acting as a joint controller of your information and therefore we advise you to read their Privacy Policy. These third-party solution providers will share your information with us which we will use in accordance with this policy.

We may also transfer your personal information to a third-party as part of a sale of some or all of our business and assets to any third-party or as part of any business restructuring or reorganisation, or if we’re under a duty to disclose or share your personal data in order to comply with any legal obligation or to enforce or apply our terms of use or to protect the rights, property or safety of our staff, supporters, customers, users of the website or others. However, we will take steps with the aim of ensuring that your privacy rights continue to be protected.

Marketing communications

We may use your contact details to provide you with useful information about solutions and products we offer from time to time. However, we will not overwhelm you with marketing messages and communications. 

Email/Text/Phone

We will only send you marketing communications by email, text and telephone if you have explicitly provided your prior consent. You may opt-out of our marketing communications at any time by clicking the “unsubscribe” link at the end of our marketing emails.

Post

We may send you marketing communications by post unless you have told us that you would prefer not to hear from us.

Accessing and controlling your data

Under current data protection legislation, you have certain rights over the data we hold about you. The most important of these are:

  • You have a right to request access to the personal data that we hold about you. If you want to access your information, please send a description of the information you would like to see and proof of your identity by email or post to the address provided below.
  • You have the right to have inaccurate or incomplete information we hold about you corrected. The accuracy of your information is important to us so we’re working on ways to make it easier for you to review and correct the information that we hold about you. In the meantime, if you change email address, or if you believe any of the other information we hold is inaccurate or out of date, please contact us via email at marketing@talentpredix.com  
  • You have a right to ask us to restrict the processing of some or all of your personal information if there is a disagreement about its accuracy, or we’re not lawfully allowed to use it.
  • You may ask us to delete some or all your personal information and we will do so as far as we are required to. In certain cases, we will anonymize that information, rather than delete it entirely.
  • If we are processing your personal information (1) based on your consent, or in order to enter into or carry out a contract with you, and (2) the processing is being done by automated means, you may ask us to provide it to you or another service provider in a machine-readable format.
  • You have the right to object to processing where we are using your personal information (1) based on legitimate interests, (2) for direct marketing or (3) for statistical/research purposes.

We will endeavour to respond fully to all requests within 10 working days of receipt of your request, however, if we are unable to do so we will contact you with reasons for the delay.

Keeping your information safe

When you give us personal information, we take steps to ensure that appropriate technical and organisational controls are in place to protect it.

Any sensitive information (such as credit or debit card details) is encrypted and protected with the following software: 128 Bit encryption on SSL. When you are on a secure page, a lock icon will appear on the bottom of web browsers such as Microsoft Internet Explorer.

Non-sensitive details (your email address etc.) are transmitted normally over the internet, and this can never be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk. Once we receive your information, we make our best effort to ensure its security on our systems.

Like many other websites, this website uses cookies. ‘Cookies’ are small pieces of information sent by an organisation to your computer and stored on your hard drive to allow that website to recognise you when you visit. This helps us to deliver a more personalised service when you browse our website and improves our services.

TalentPredix Statement on GDPR Compliance

TalentPredix knows you care how information about you is used and appreciates your trust that we will do so carefully and sensibly. TalentPredix takes a proactive approach to safeguard the confidentiality of all information. We use a variety of industry-standard administrative, physical, and security technologies and procedures to help protect personal information from unauthorized access, use, or disclosure. TalentPredix is committed to the security, availability, confidentiality, and processing integrity of all information collected, regardless of location.

TalentPredix maintains an information security and privacy program consistent with industry standards, which includes appropriate administrative, physical, and technical safeguards to a) maintain and protect against anticipated threats or hazards to the security, privacy, confidentiality, and integrity of data; and b) protect against any security incident. Additionally, TalentPredix has undertaken thorough GDPR readiness and impact assessments to ensure the proper policies and procedures are in place for compliance.

In regard to GDPR, TalentPredix is generally considered a Processor or Sub-Processor, although there may be some instances where TalentPredix is a Controller (i.e. customer relationship management, accounting processes). As such, TalentPredix’s legal basis for processing data will typically rely on the following provisions: Article 6(1)(b) ‘performance of a contract’, and Article 6(1)(f) ‘legitimate interest’.

Data Retention

Data will be retained by TalentPredix 1) for as long as the Controller or Processor is a client of TalentPredix, 2) until the data is requested to be deleted by the Controller, Processor, or Data Subject, or 3) until the data is no longer necessary to provide the requested services. Anonymized data may be aggregated for our own research purposes.

EU Data Protection and Model Clauses

The following information is accurate on the ICO website as per the latest update of this policy:

For transfers from the EEA into the UK, the EU GDPR rules on restricted transfers will apply. The UK Government is seeking a European Commission ‘adequacy decision’ which will allow the free flow of data under those rules. To allow time for the EU to consider whether to grant such an adequacy decision, as part of the new trade deal, the EU has agreed to delay transfer restrictions for at least four months (known as the bridge). This may be extended to six months. On 19 February 2021 the European Commission published its draft decisions on the UK’s adequacy under the EU’s General Data Protection Regulation (EU GDPR) and Law Enforcement Directive (LED). In both cases, the European Commission has found the UK to be adequate. The draft decisions will now be considered by the European Data Protection Board (EDPB) and a committee of the 27 EU Member Governments.  If the committee approves the draft decisions, then the European Commission can formally adopt them as legal adequacy decisions. In the absence of an EU ‘adequacy decision’ at the end of the bridge, these transfers will need to comply with EU GDPR transfer rules. Our end of transition guidance will help you to prepare for changes to receiving personal data from the EEA.

TalentPredix utilizes the European Commission’s Standard Contractual Clauses developed and approved as ensuring adequate protection for data subjects in accordance with the EU Data Protection Directive 95/46/EC. The SCC are generally referenced within a Data Processing Agreement entered between TalentPredix and applicable parties. TalentPredix will implement any GDPR-specific clauses promulgated by the regulatory body when available.

Technical Security

TalentPredix™ has extensive security and privacy policies and procedures which serve as a strong foundation to address the key components within GDPR legislation. An important component of our current security and privacy compliance is the US-based SSAE 18 Service Organization Control (SOC2) Trust Principles. SOC2 compliance and audits map to ISO standards, and as such, share many principles with GDPR in the areas of technical and organizational measures on data security, availability, processing integrity, confidentiality and privacy.
